The Australian mandatory standard for toys for children up to and including 36 months of age has been updated on 5 September 2023.

The “Consumer Goods (Toys for Children up to and including 36 Months of Age) Safety Standard 2023” replaces the “Consumer Protection Notice No. 14 of 2003 — Consumer Product Safety Standard: Toys for children up to and including 36 months of age” with a transitional period of 18 months.

From 5 March 2025 manufacturers must only comply with the updated standard.

The mandatory standard sets requirements for the design and construction of toys for children up to and including 36 months of age.

The previous mandatory standard (Consumer Protection Notice No. 14 of 2003) was based on an old revision of the voluntary Australian/New Zealand standard, AS/NZS ISO 8124.1:2002.

The updated mandatory standard allows compliance with one of the following standards:

  • AS/NZS ISO 8124.1:2023 “Safety of toys – Part 1: Safety aspects related to mechanical and physical properties”
  • ISO 81241:2022 “Safety of toys – Part 1: Safety aspects related to mechanical and physical properties”
  • EN 711:2014 + A1:2018 “Safety of toys – Part 1: Mechanical and physical properties”
  • ASTM F96317 “Standard Consumer Safety Specification for Toy Safety”

The updated mandatory standard also requires electric toys to comply with AS/NZS 62115:2018 “Electric toys – Safety” clause 13.4.1 “Small batteries”.

It has to be noted that the mandatory standard only mandates certain sections in the standards mentioned above with some modifications. However, it is always the best industrial practice to also comply with all the applicable sections in the standards.
